Tattoo Design Theif!

We have found a site that has stolen over 100 of our designs, many of Freeone's designs, many of JSH's designs and many others but I do not recognize the names that go along with the designs and tattoos. Everyone needs to go and check and see if your pieces have also been stolen as I'm sure EVERYTHING on the site is stolen. The site is www.freetribaltattoo.com the owner of the site is karamveer singh <karamveer@yahoo.com>. We are looking into legal action if anyone else has had their designs stolen and would like to join with us you can email us at kajinrose@scorpionsamore.com.

there is really no such thing as a tattoo design thief all tattooists have there own style and usually change the pattern to fit there own needs and there own style there isn't a pattern out there that has never been drawn or tattooed. Iv'e always thought that as tattoo artists we were kind of different and we stuck together but i have been wrong before anyway that to me is just being helpful with another persons art think on this and tell me what you think

Having went to the above said web site I find very old used up tattoo flash designs some I'm sure go back to old Huck Spalding catalogs. Many Artists take inspiration from many places, if you are going to have a Art piece judged it should be of original work or taken from a photo that you took, other than that you should as Darrin said give credit as due to the original Artist even if its for inspiration. Why back when there were lots of Tattoos of a little mouse that caused a lot of law suits, if its changed by 5%, in the eyes of the law its not a copy. Oh by the way I love doing Art reproductions on skin as well as freehand originals and yes flash too. If is a Tattoo really its pretty much one of a kind...

As an artist I feel if you don't want something reproduced you shouldn't make it available online. That's the risk you run displaying artwork for the masses. On that note, it is custom in many circles to give credit where it is due, and the at the very least you should probably mention the original artist if you are going to display some one elses work.
Charging for someone else's work is a big issue for me. Prints and whatnot should not be sold by anyone other than the artist who created them, and that is where copyright comes in.

Imitatation is the sincerest form of flattery.When I was in the army at the age of 17,I walked into a shop and looked through the guys art,and some magazines and saw IT! Guy had a piece on his entire chest I wanted bad. The Artist sized it down to a shoulder piece and put it in me.I think if he found out someone was doing his art on someone else, he might have bitched about it.I get the feeling that most artists have done this type of transaction in some form, at some time. Hypothetical situation: a guy walks in and wants a pink floyd on his ass cheek,could be anywhere but the ass is funnier so I will go with that.Answer these questions honestly to yourself: 1)Do you refuse to do the art?
2)If you do the art,do you call up mister pink and ask his permission?
3)Do you cut mister pink a check for using his art or copyrighted logo?
I'll bet the answers for 99.9999% of us will be no,no and no.In my book if you are the .0001% that have NEVER used ANYONE's art on a customer then your gripe is legit.If you aren't then your are a hypocrite.

i don't see anything to be upset about on the freetribaltattoo site . . . . it's all bad bad incredibly bad flash and even worse pictures of tattoos of that bad flash
how can anyone be upset about the theft of trash?

I am not an attorney and this is not legal advice, but legally speaking, Tattoo Design theft is almost impossible to do if the design was originally drawn as tattoo flash. You can not copyright a design that was designed with the intent to sell and copy.
Tattooing is the only art form who's artists draw art (flash) with the intention of it being sold and then copied by another tattooer. And that makes most tattoo designs not copyright protectable, other wise Ed Hardy would not be able to use all those designs he did not originally draw.
Another point of law applies to the work for hire clause of the copyright law of 1976. Most tattoo work that is not custom drawn on the spot by the artists falls under the work for hire clause and therefore not copyrightable by the tattooer. The copyrights belong to the client when it is a work for hire situation.
Under the circumstances you may not have any copyrights to begin with. Check with your attorney.

The real concern should be when a tattoo trade magazine or convention organizer uses a photograph of your tattoo work for promotion of their product, and either doesn't give the artist credit, or refuses to delete the uncredited work when asked by the tattooer. Or refuses to compensate the tattooer for the use of their work.
The theft and unauthorized use of a tattoo artists work even when the tattoo work not actually copyright protectable, is the ethical problem that is a plague to the profession, and has been for a long time.
when understood, Copyrights give the Tattooer negotiating ability when magazine want to publish the work.

Of course you can copyright a design that is made to be sold and copied. The tattoo not, but the flash art itself absolutely. Artists put their time into the flash they create, with the intent of selling it and making a bit of money back on it, not with the desire for it to be stolen. It is meant to be copied only by those who purchase the "license" to do so by shelling out for the flash in the first place. Ed Hardy is using designs that had no copyright, but it does not immediately follow that all tattoo flash is non-copyrightable. In the same way it is not true to assume that because there are many photographic and fine art images freely available, then all images that exist then must be without copyright.
The work for hire clause of copyright has no bearing on the issue here and is irrelevant in the case of flash, which is not a work for hire situation by law nor by logic.
I do understand the comment another tattooist posted here, that it is crap work copied in a crap way, but all that old HS tribal flash (sorry, but in my opinion another example of crap) from the eighties and nineties has made money for almost every tattooer working today, at least in the beginning of their careers.
Our industry is still seen by most outside as lowbrow, and therefore empty "art", but it is lowbrow art enjoying a popularity boom at the moment and so of course people will try to steal the imagery and make a few quick bucks off of it - of course they will choose the mass-pleasing stuff like tribal or nonsense with stars and butterflies or goofy Grim Reaper designes, but just because it is crap that they are stealing doesnt mean that the original source of that crap doesnt have first right to cash in on his/her own work.

if you dont want your shit copied then keep it off the internet...ive been tattooing 12 years professionally and have done everything under the sun...my design or someone elses it doesnt matter its art get over it and draw something...we all use each others designs either as a jumpstart to a new design or right off the wall...
